What to do if you are in a car accident in North Carolina

In North Carolina in 2015, there were more than 80,000 reported car crashes that caused injuries to motorists, passengers, bicyclists or pedestrians. Of those crashes, more than 1,200 resulted in fatalities. Across the state, auto accidents have increased sharply in the last several years because the growing economy and availability of cheaper gasoline have put more cars on the road. If you are involved in a serious traffic accident, here are some steps to take immediately:

  • Get your vehicle out of traffic — A secondary collision from an approaching vehicle is often deadlier than the first crash. If your car is not disabled, move it. If it is disabled, keep it lighted and place traffic cones, florescent triangles, or road flares behind the vehicle to divert traffic.
  • Administer first aid as necessary — Take care of yourself and your passengers. Remember never to move an injured passenger unless a fire or other hazard puts them at severe risk. You also have a legal duty to render reasonable assistance to injured parties in other vehicles.
  • Call 911 — Alert the police and request an ambulance.
  • Exchange identifying information with other driver(s) — This is another legal requirement. However, if you are concerned for your safety, remain in place until the police arrive.
  • Get contact information from witnesses — If anyone stops, request a business card or some way of contacting them later.
  • Take photos — Use your cellphone to get pictures of the accident scene, vehicle damage, and injuries.
  • Address any concerns to the police — If you believe the other driver may be intoxicated or had been speeding or otherwise negligent at the time of the crash, make your thoughts known to the police. Never engage the other driver directly about these issues. Ask police where you can obtain a copy of the accident report.
  • Seek medical attention — Even if you are not sure whether you’ve been injured, get yourself checked out. This is important for your health and for your future litigation.

Finally, call Sherrill & Cameron, PLLC right away so we can begin a thorough investigation into the cause of your accident.

What are North Carolina's auto insurance laws?

Like other states, North Carolina requires all drivers to have liability insurance. The statutory minimum levels of coverage in the state are:

  • $30,000 bodily injury (BI) for a single person
  • $60,000 total bodily injury (BI) for a single person
  • $25,000 for all property damage (PD)

These minimum levels, however, may not be adequate to pay for your injuries; even worse, you might have been hit by an uninsured driver. In either case, you may have to file an uninsured/underinsured motorist claim with your own insurance company. This can put you in an adversarial position with two insurers at once! That’s when you really need an experienced auto accident attorney managing your claim.

At Sherrill & Cameron, PLLC, our experience in negotiating with auto insurance companies means we often achieve results in your favor, even when your insurance claim had been denied. We know how to keep your case from going to court, avoiding a lengthy battle between you and your insurance company. Our attorneys pursue swift justice on your behalf to address your physical and financial recovery.
